1. About EXAPS and These Terms
1.1. These Terms of Use (“Terms”) govern your use of the EXAPS website at https://www.exaps.org and any related pages, content, tools, features, or services made available through it (together, the “Site”).
1.2. The Site is operated by Expats Alliance of Professional Standard Limited, a company registered in England and Wales with company number 16830433 and registered office at:

In these Terms, “EXAPS”, “we”, “us”, and “our” refer to Expats Alliance of Professional Standard Limited.
1.3. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
1.4. These Terms apply to: - Visitors and users of the Site (including expatriates and immigrants searching for providers); and - Organisations applying for, or holding, EXAPS membership (“Members”).
1.5. Additional terms may apply to Members, including the EXAPS Code of Conduct and any Membership Agreement (together, “Member Terms”). If there is a conflict between these Terms and any Member Terms, the Member Terms will prevail for Members.
2. Language and Prevailing Version
2.1. The Site (and these Terms) may be made available in multiple languages. Translations are provided for convenience only.
2.2. If there is any inconsistency, conflict, or ambiguity between the English version and any translated version, the English version will prevail.
2.3. We may update the English version from time to time. Translations may not be updated immediately.
3. Eligibility and Access
3.1. You must be at least 18 years old to use the Site. By using the Site, you confirm that you are 18 or older and have legal capacity to enter into these Terms.
3.2. We may restrict, suspend, or terminate access to the Site (or parts of it) at any time, without notice, if we reasonably believe you have breached these Terms or for operational, security, or legal reasons.
4. Nature of EXAPS and Our Role
4.1. EXAPS is an international professional membership alliance. We provide: - A framework of standards and a Code of Conduct for Members; - A directory and visibility platform for Members; and - A process for receiving and reviewing complaints about Members.
4.2. EXAPS is not: - A law firm, financial institution, or regulated adviser; - A regulator, ombudsman, or dispute resolution authority; or - A party to any contract between you and a Member.
4.3. Information on the Site is for general information only. It does not constitute legal, financial, tax, immigration, or other professional advice. You should obtain independent professional advice before making decisions based on information found on the Site.
5. Directory Listings and Third-Party Services
5.1. The EXAPS International Directory lists Members who have agreed to follow the EXAPS Code of Conduct and who have passed our basic checks at the time of admission.
5.2. Basic checks are limited and do not amount to certification, accreditation, or a guarantee of competence, solvency, suitability, or service outcomes.
5.3. We do not: - Guarantee the accuracy, completeness, or ongoing suitability of any Member’s services; - Endorse or recommend any particular Member beyond confirming their membership status; or - Accept responsibility for any advice, services, or outcomes provided by Members.
5.4. Any relationship between you and a Member is a separate contract between you and that Member. EXAPS is not responsible for, and will not be liable for, any loss or damage arising from such relationships.
5.5. While we may take action under our Code of Conduct (including suspension or removal of Members), we are not obliged to intervene in individual disputes and are not liable for any failure to do so.
6. Complaints and Feedback
6.1. If you have a concern about a Member, you should first raise it directly with that Member using their own complaints process.
6.2. You may then submit a complaint to EXAPS using the process described on the Site. We may: - Request information from you and from the Member; - Review the matter in line with our internal policies; and - Decide whether to take action regarding the Member’s EXAPS status.
6.3. Our role is limited to assessing compliance with the EXAPS Code of Conduct. We do not provide legal remedies or compensation and do not act as your representative.
6.4. We may decline or discontinue a complaint review at our discretion, for example where information is incomplete, the matter is outside our scope, the matter is anonymous, abusive, or vexatious, or legal proceedings are ongoing.
7. Your Responsibilities and Acceptable Use
7.1. You agree that you will: - Use the Site only for lawful purposes and in accordance with these Terms; - Not misuse the Site, interfere with its security, or attempt to gain unauthorised access; - Not submit any content that is unlawful, defamatory, misleading, discriminatory, or infringes the rights of others.
7.2. You must not (or attempt to): - Use any automated system (including bots, scrapers, spiders, or data-mining tools) to access, copy, or monitor any part of the Site without our prior written consent; - Circumvent, disable, or interfere with security-related features or access controls; - Introduce viruses, malware, or other harmful material; - Use the Site to send unsolicited marketing communications to Members or other users.
7.3. If you submit information to us (for example, via contact forms, complaint forms, or membership applications), you confirm that: - The information is accurate to the best of your knowledge; and - You have the right to provide it to us.
7.4. You must not use the EXAPS name, logo, or badge in any way that suggests you are a Member unless you have been formally accepted as a Member and comply with our branding guidelines.
8. User Submissions
8.1. The Site may allow you to submit information, documents, messages, or other materials (“Submissions”).
8.2. You retain ownership of your Submissions. However, you grant EXAPS a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, and communicate your Submissions to the extent reasonably necessary to: - Operate and improve the Site; - Process membership applications; - Administer and review complaints and Code of Conduct matters; and - Maintain records for compliance, audit, and legal purposes.
8.3. We may remove, edit, or refuse to publish any Submission at our discretion. We are not obliged to display or act on any Submission.
9. Intellectual Property and Trade Marks
9.1. All content on the Site, including text, graphics, logos, icons, images, the EXAPS badge/mark, and software (together, “Content”), is owned by or licensed to EXAPS and is protected by copyright, trade mark, and other intellectual property laws.
9.2. “EXAPS”, the EXAPS logo, and the EXAPS Trusted Provider badge/mark are trade marks (registered or unregistered) of EXAPS (together, “Marks”).
9.3. You may: - View and print pages from the Site for your personal or internal business use; and - Share links to public pages of the Site.
9.4. Except as expressly permitted by these Terms (or in writing by us), you may not: - Copy, reproduce, modify, distribute, or commercially exploit any part of the Site or Content; - Use any Marks in a way that implies endorsement, approval, regulation, certification, or membership where this is not the case; - Alter, obscure, or remove any copyright, trade mark, or other proprietary notices.
9.5. Member licence (where applicable). If you are a Member, you may be granted a limited, revocable, non-transferable licence to use certain Marks (including the EXAPS Trusted Provider badge/mark) strictly in accordance with: - Your Member Terms; - Any EXAPS brand guidelines; and - Any scope/format rules we notify to you.
9.6. If your membership is suspended, terminated, or expires (or if we request it for any reason), you must immediately stop using the Marks and remove them from your websites, social media, marketing materials, and any other use.
10. Privacy and Data Protection
10.1. We process personal data in accordance with applicable data protection laws, including the UK GDPR and, where relevant, the EU GDPR.
10.2. Our Privacy Policy explains how we collect, use, and protect your personal data. By using the Site, you acknowledge that your personal data will be processed in accordance with that policy.
10.3. Members are responsible for complying with data protection laws in their own handling of client and user data. EXAPS is not responsible for how Members process personal data in their own businesses.
11. Third-Party Links
11.1. The Site may contain links to third-party websites, platforms, or services (including Member websites). These links are provided for convenience only.
11.2. We do not control third-party sites and are not responsible for their content, availability, or privacy practices. Your use of third-party sites is at your own risk and subject to their terms.
12. Changes to the Site and These Terms
12.1. We may update, modify, suspend, or remove content on the Site at any time without notice.
12.2. We may change these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
13. Disclaimers
13.1. The Site is provided on an “as is” and “as available” basis. We do not guarantee that: - The Site will be uninterrupted, error-free, or secure; or - The content on the Site is complete, accurate, or up to date.
13.2. We do not warrant that the Site (or any content downloaded from it) will be free from viruses or other harmful components. You are responsible for using appropriate security and anti-virus protection.
13.3. To the fullest extent permitted by law, we exclude all warranties, representations, and conditions (whether express or implied) relating to the Site and its content.
13.4. Nothing in these Terms excludes or limits any warranty or liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
14. Limitation of Liability
14.1. To the fullest extent permitted by law, EXAPS will not be liable for: - Any loss of profits, revenue, business, or anticipated savings; - Any loss of goodwill, reputation, or data; or - Any indirect or consequential loss or damage,
arising out of or in connection with your use of, or inability to use, the Site or reliance on any content on it.
14.2. If we are found liable to you, our total aggregate liability in respect of all claims arising out of or in connection with the Site and these Terms will be limited to £1,000, unless a different cap is expressly agreed in writing with you.
14.3. Nothing in these Terms affects any rights you may have as a consumer under mandatory laws of your country of residence.
15. International Use
15.1. The Site may be accessed from countries around the world. We do not represent that the Site or its content is appropriate or available for use in all locations.
15.2. You are responsible for complying with local laws that apply to you, including any laws relating to professional regulation, advertising, and consumer protection in your country.
15.3. Membership of EXAPS does not replace or override any legal or regulatory requirements that apply to Members in their own jurisdictions.
16. Termination
16.1. We may suspend or terminate your access to the Site at any time if we reasonably believe you have breached these Terms or if required by law.
16.2. Termination of your access to the Site does not affect any rights or obligations that have already arisen for you or for us.
17. Governing Law and Jurisdiction
17.1. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales.
17.2. The courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or your use of the Site, subject to any mandatory rights you may have under the laws of your country of residence.
